DRAFT FOR REVIEW
Customer Agreement & Workmanship Warranty
Important: This is a business-document draft for review, not legal advice. Before using it with customers, have a Mississippi attorney review it and confirm that your licensing, permitting, insurance, and scope-of-work practices comply with applicable law.
1. Scope of Work
Odom Connections L.L.C. (“Contractor”) will perform only the electrical services specifically described in the written estimate, proposal, work order, or other signed project document. Additional work requires customer authorization and may result in additional charges.
2. Customer Authorization
The customer authorizes Contractor to perform the approved scope of work and represents that the customer has authority to authorize work at the property. Customer agrees to provide reasonable access to the work area and disclose known conditions that could affect the work.
3. Existing Conditions
Electrical systems can contain concealed, damaged, outdated, or nonconforming conditions that cannot reasonably be identified before work begins. If such a condition is discovered, Contractor may pause affected work and provide the customer with options and any additional estimate before proceeding, except where immediate action is reasonably necessary for safety.
4. Permits, Inspections & Code Requirements
Where permits or inspections are required, the parties will determine responsibility for obtaining them in the written project documents. Work will be performed in accordance with applicable requirements to the extent those requirements apply to the authorized scope.
5. Workmanship Warranty
Unless a project document states a different written warranty period, Contractor warrants its workmanship for 12 months from substantial completion. This warranty covers defects directly caused by Contractor’s workmanship in the completed scope.
The warranty does not cover customer-supplied materials, manufacturer defects, normal wear, misuse, alterations by others, damage caused by external events, pre-existing conditions, concealed conditions, or work outside Contractor’s authorized scope.
6. Warranty Remedy
For a valid workmanship claim, Contractor’s primary remedy will be to inspect the reported issue and, when covered, repair or correct the affected workmanship within a reasonable time. The warranty does not automatically guarantee replacement of equipment or materials supplied by others.
7. Payments & Changes
Payment terms, deposits, progress payments, change orders, and any applicable cancellation terms will be stated in the project estimate or work order. Approved additional work may be billed separately.
8. Safety
Customers must not energize, modify, disconnect, or permit another person to modify completed work in a way that could affect the installation without appropriate authorization. Contractor may stop work when unsafe conditions are encountered.
9. Limitation of Responsibility
Nothing in this agreement is intended to waive rights or responsibilities that cannot legally be waived. Any limitation of liability must be interpreted only to the extent permitted by applicable law.
10. Written Acceptance
Customer acceptance should be documented on the applicable estimate, proposal, work order, or electronic signature form. The customer should receive a copy of the signed agreement and project documents.
